HereWithYou Terms of Use & Service, Effective Date: March 13, 2025

 

Overview

 

Welcome to HereWithYou! These Terms of Use ("Terms") govern your access to and use of the HereWithYou platform, including our desktop and mobile website, app, possible future/current products, and services (collectively, the "Services"). These Terms govern your access and use of HereWithYou and its Services, and are provided to you by HereWithYou LLC and the site operator and hosting service, Wix. “We” collectively refers to HereWithYou and the site operator, Wix. By accessing or using our Services, you agree to these Terms. If you do not agree, do not use HereWithYou or our other Services covered by these Terms. These Terms therefore constitute an agreement between you and HereWithYou LLC. 

 

HereWithYou develops and maintains technologies and services that enable people to connect with each other, build communities, and foster growth amongst creators and businesses. 

 

We do not charge you to use HereWithYou or any of its products and services covered by these Terms unless stated otherwise. Instead, we are volunteer-driven and self-funded by the HereWithYou Team and the site’s creators. We are also funded and able to grow thanks to donations from like-minded persons and organizations who share in our values and mission.

 

We don’t sell your personal data to advertisers, and we don’t share information that directly identifies you (e.g., your name, email address, or other contact information). Our Privacy Policy explains how we (as in our site host, Wix) collect and use your personal data to provide services related to the following:

 

  • Provide, personalize, and improve HereWithYou;

  • Communicate with you, including sending updates, security alerts, and support messages;

  • Enhance security and prevent fraud;

  • Comply with legal obligations.

 

HereWithYou and our host site, Wix, do not sell your personal information. However, we may share it in the following situations:

 

  • With Service Providers: We share data with partners who help us operate HereWithYou, such as hosting providers, analytics services, and customer support tools. Many of these service providers are all under the umbrella of our site operator, Wix.

  • With Other Users: If you interact with or follow other users, your profile information and shared content may be visible to them.

  • For Legal Reasons: If required by law, we may disclose information to comply with legal requests or protect our rights and users.

 

1. The Services We Provide

 

Our mission is to promote a space that is kind, respectful, and inclusive—and that recognizes all people are inherently deserving of being treated equally in dignity and rights—regardless of identity, innate characteristics, or beliefs. We seek to foster authentic connection, joy, resilience, and growth through the features available to our HereWithYou community. We strive to give people the power to build community and come together. To do so, we provide Services described below to you:

 

1.1 Provide a personalized experience for you:

 

Your experience on HereWithYou is unique to you: from Groups, Forums, Member Chats, the Blog, to various posts/comments made. Our host site, Wix, may use this data about the connections you make in its analytics of site users; however, you can opt-out of this at any time by rejecting non-essential cookies.

 

1.2 Connect you with people, artists, creators, and groups you care about:

 

We help you discover and connect with people, groups, artists, makers, creators, businesses and organizations, and others that matter to you across our platform. Our site host, Wix, may make suggestions for you and others (i.e., recommending a Group to follow) based on how you use the HereWithYou platform.

 

1.3 Help you discover and connect you with content and services that may interest you:

 

We provide resources, social accounts, websites, books, articles, scientific journals, podcasts, videos, and other content to help you discover information that may be of interest to you. None of these services pay HereWithYou or its team to bring this content to you–this content is hand-selected by the HereWithYou Team, or comes from suggestions from our users after being vetted by our HereWithYou Team.

 

1.4 Empower personal expression and communication about what matters to you:

 

There are many ways to express yourself on HereWithYou and to communicate with friends and other users about what matters to you–posting in Forums, Groups, creating your own Group, commenting in either Groups or Forums, and messaging via our Member Chat. We ask that the content you do share and express abides by our Community Standards, Code of Conduct, and Site Rules.

 

1.5 Promote the safety, integrity, and security of our Services; take action against harmful conduct and keep our community of users safe:

 

People will only build community on our HereWithYou site and app if they feel safe and secure. We (HereWithYou and our host site, Wix) work diligently to maintain the security (integrity, confidentiality, availability, and authenticity) of our site and Services. We partner with our parent and host site, Wix, to ensure advanced technical and security systems are in place to detect potential misuse of our site, harmful conduct towards others, and situations where we may be able to support or help protect our community–including responding to user reports of potentially violating content. If we learn of content or conduct such as this, or that does not abide by our Community Standards, we may take appropriate action based on our assessment which may include the following: notifying you of the violation, removing the violating content, removing or restricting user access to certain features, disabling a user’s account, or contacting law enforcement.

 

1.6 Use advanced technologies to provide functional and safe services for all users:

 

We (and our host site, Wix) may use advanced technologies–such as artificial intelligence, augmented reality, or machine learning systems–so that people can use our Services safely regardless of physical ability or geographic location (e.g., technology that helps people with visual impairments understand who or what is in photos or videos shared on HereWithYou). We may also use these systems to detect and remove abusive and dangerous activity and content that may harm our community or the integrity of our Services.

 

1.7 Provide a seamless and consistent experience across the various platforms that HereWithYou is available on:

 

Our sites and Services are designed to have an experience that is consistent across whatever device is used to access them–from a desktop site, mobile site, and eventual app.

 

1.8 Ensure access

 

To operate our site and enable our users to connect with people all over the world, our site operator Wix needs to transfer, store, and distribute content and data to its data centers, partners, service providers, vendors and systems at various geographic locations. The use of this infrastructure is necessary and essential to providing our Services and maintaining security of users data. This infrastructure may be owned, operated, or controlled by Wix or its service partners.

 

2. Who Can Use HereWithYou

 

You may use our Services only if you meet the following requirements:

 

  • You are at least 13 years old (or the minimum legal age in your country).

  • You are not a convicted sex offender.

  • You have not been previously banned from using our Services for violation of our Terms, Community Standards, or other terms and policies that apply to using HereWithYou.

  • You agree to comply with all applicable laws and regulations.

3. Your Commitments

 

When using HereWithYou, you agree to:

 

  • Abide by these Terms, our Community Standards, and other terms and policies.

  • Provide accurate and truthful information, including about your identity.

  • Create only one account and use it for personal purposes.

  • Not engage in any fraudulent, harmful, discriminatory, or illegal activities.

  • Respect the rights of others, including their privacy and intellectual property.

You must not:

 

  • Use our Services in a way that violates any laws or regulations.

  • Post or share content that you do not own or have the necessary rights to share, or content that is misleading, abusive, violent, or otherwise inappropriate.

  • Attempt to hack, interfere with, or disrupt our site or Services. This includes uploading malicious code or viruses; using the service to send spam to other users or HereWithYou team; or do anything else that could interfere with, disable, or impair the proper working, operation, integrity, or appearance of our Services or systems.

  • Attempt to access data you do not have permission to access.

  • Proxy, request, or collect usernames or passwords.

  • Sell, license, or purchase any data obtained from HereWithYou or our Services, regardless of whether such data was obtained while logged into the site or app.

  • Misuse our reporting or flagging system, dispute, or appeals channels, such as making fraudulent or groundless reports/appeals.

  • Attempt or do anything to bypass or override any technological measures that HereWithYou or Wix uses to control or limit access to certain data.

 

We can and will remove or restrict access to content that is in violation of these provisions. 

 

We can and will suspend or disable your account for conduct that violates these provisions.

 

Removal of Content

 

If we remove content that you have shared in violation of our Community Standards or Terms, we make attempts to let you know why we removed it and explain any options you have to request review, unless you seriously or repeatedly violate these Terms or if doing so may expose HereWithYou or others to legal liability; harm our community of users; compromise or interfere with the integrity and operation of the site and our Services; where we are restricted due to technical limitations; or where we are prohibited due to legal reasons.

 

To combat misinformation that may lead to harm to others or communities, we may employ fact-checking services and add a notice to your content if said content is health-related or scientifically based, and not accurate or consistent with current scientific information and standards (or fully remove depending on the nature of harm of the information).

 

To help support the community, we encourage our users to report content or conduct that they believe violates other users rights, our Terms, and/or our Community Standards.

4. Your Content and Permissions

 

When you share, post, or upload content on HereWithYou, you grant us legal permission and a non-exclusive, worldwide, royalty-free license to host, use, distribute, and display that content as needed to operate and improve our Services. For example, if you share a photo, you give us permission to store, copy, and share it with others wherever you choose to post it so that it appears on the website (consistent with your privacy settings on the site). 

 

You retain ownership of your content but agree not to post anything that violates others' rights. Nothing in these Terms takes away your rights to your own content, and you are free to share your content wherever else you would like.

 

You can delete your content at any time; in addition, any content you post from your account will be removed if you delete your account. A request to delete your data will notify the HereWithYou site creators. They will work to remove your data within 48 hours of your request. They will also submit that data removal request to Wix, the site operator and host. It may take up to 7 days to delete all content related to you from both systems; however, once the content and/or account is deleted, it is no longer available to view by other users. We will notify you when this process is complete and your data is permanently erased.

 

5. Privacy and Data Protection

 

Your privacy is important to us. Our Privacy Policy outlines how we collect, use, and protect your information. By using our Services, you agree to the collection and use of your data in accordance with our Privacy Policy.

 

6. Intellectual Property Rights

 

All content and materials provided by HereWithYou, including logos, trademarks, and software, are the property of HereWithYou or its licensors. You may not copy, modify, distribute, or use our intellectual property without permission.

 

7. Account Suspension or Termination

 

We may suspend or terminate your account if you violate these Terms, Privacy Policy, Site Rules, Code of Conduct, or Community Standards; engage in harmful behavior; or if we believe your actions put HereWithYou or others at risk. If your account is terminated, you may lose access to your content and data.

 

When we take such action, we will make attempts to let you know and explain any options you may have to request a review, unless doing so may expose HereWithYou or others to legal liability; harm our community of users; compromise or interfere with the integrity and operation of the site and our Services; where we are restricted due to technical limitations; or where we are prohibited due to legal reasons.
 

8. Disclaimers and Limitation of Liability

 

HereWithYou provides the Services "as is" and does not guarantee uninterrupted or error-free service.

 

We are not responsible for content shared by users or for any harm resulting from the use of our Services.

 

To the extent permitted by law, HereWithYou is not liable for any indirect, incidental, or consequential damages.

9. Changes to These Terms

 

We may update these Terms from time to time. If we make significant changes, we will notify you through our Services. Continued use of our Services after changes means you accept the updated Terms.

 

10. Governing Law and Dispute Resolution

 

These Terms are governed by the laws of the State of Minnesota. Any disputes will be resolved through arbitration or the courts in the the Hennepin County District Court (Fourth Judicial Circuit) or the United States District Court for the State of Minnesota, unless otherwise required by law.
